Compliance

SmartPay ensures compliance with all legislation in relation to temporary workers. As SmartPay is an independent UK business, our umbrella employment service ensures there are no risks to your business from the MSC or the associated Transfer of Debt legislation, and no risks to your workers from IR35. SmartPay do not provide personal service or composite companies to provide the services of individual workers and we do not pay dividends to workers.

Our standard business contracts are written to ensure there can be no doubt that they are contracts for service to give you the security that no worker can be deemed to be an employee of your business. Furthermore our Employment Agreement is written in line with HMRC’s own expectations of a genuine ‘over-arching’ agreement, ensuring all assignments undertaken by your workers will be under their ongoing SmartPay employment.

We are fully registered with HMRC for Corporation Tax and PAYE, and ensure that all PAYE / NIC returns and payments are made on time every time.

Insurance

SmartPay holds a high level of primary insurance covering all of our employed workers. We provide the following cover:

  • Employers Liability to £10 million
  • Public Liability to £5 million
  • Professional Indemnity to £5 million

Administration

We utilise tried and tested systems that allow us to process large volumes of invoices and payments automatically. Our systems can cope with the raising of a single invoice from a timesheet provided by a worker through to invoicing schedules covering many workers within a single invoice and payment.

This flexibility and processing power enables our clients to save time and bank charges by making a single payment for all their workers, enabling us to make timely onward payments to workers, fulfilling their expectations.

Our automated systems ensure that we are able to comply with all the requirements of HMRC and other government agencies in relation to all required returns and payments on account of the worker payments that we process.
